BREAKING NEWS THE EQUALITY BILL UPDATED

The Equality Bill recently completed its third reading in the House of Lords, resulting in amendments. The Bill now returns to the House of Commons.
 
Below is a brief summary of the Lords’ amendments to this very important new legislation.
 
General changes to the Bill:
 
  • Adding a power to prohibit ‘caste discrimination’ as part of ‘race discrimination’.
  • Making it explicit reasonable adjustments for disabled people includes taking reasonable steps to provide information in accessible formats, when information is provided which would put disabled people at a substantial disadvantage.
  • Ensuring that all people who conduct religious marriages can continue to opt out if reasonably believe that a marriage involves someone who has ‘changed gender’.
  • Extending protection against discrimination because of pregnancy and maternity to pupils in schools.
  • Removing the prohibition on civil partnerships taking place in religious premises.
  • Clarifying “substantial” as used in relation to disability, means something which is not minor or trivial.
  
Disability:
  • Requiring schools to provide auxiliary aids for disabled pupils, where reasonable.
  • Made clear that the costs of reasonable adjustments cannot generally be passed on to a disabled person.
  • Making it unlawful to ask job applicants disability and health questions before job offers, except in prescribed circumstances.
  • Strengthening the protection for disabled people taking or being awarded qualifications.
  • Made clear the need to take account of disabled people’s disabilities in the public sector Equality Duty,
Equal pay:
  • Made clear that a claimant can compare his or her pay (as is already the case) with a predecessor in the job as well as with current work colleagues.
  • Clarifying the need to justify differential pay based on factors that may involve indirect discrimination.
  • Widening the scope of protected pay disclosures.
